In Poniatowska v Hickinbotham [2009] FCA 680, the Federal Court ordered an employer to pay a former employee $466,000 in damages after finding that she had been subjected to unlawful sexual harassment and sex discrimination during her employment.

Significant changes to the Disability Discrimination Act 1992 (Cth) have passed through Parliament. Employers should monitor the commencement of this Act. The changes broaden the scope of direct and indirect disability discrimination, which may make it easier for employees to bring disability discrimination claims. The defence of inherent requirements will now be available to employers in a wider range of employment situations.
